9.1

The Association shall not declare or authorize a strike, work stoppage or similar industrial action by its members while this Agreement is in force provided there is no lock-out or similar industrial action by the Employer.

9.2

The Employer shall not declare or cause a lock-out of employees while this Agreement is in force, so long as there is no strike, work stoppage or similar industrial action by the Association.

9.3

An employee who refuses to cross a picket line established by another certified bargaining agent in consequence of a strike shall not be in breach of this Agreement, and shall be subject to loss of pay but shall not be subject to any disciplinary action.

9.4

During a strike, employees shall not be denied access to University facilities by the Employer or the Association unless the University is officially declared to be closed. The Association agrees, in the event of the University's being closed, that it will not impede access to University facilities of other University employees engaged in the provision of essential services such as patient care, animal care, plant care, fire prevention, security, and operation of the heating plant. The Employer agrees, in the event of the University's being closed, that it will not impede access to the University for employees when it is essential that their research and scholarly work continue.

9.5

The Employer shall not refuse to re-employ an employee as a consequence of a strike declared by the Association, or a lock-out imposed by the Employer.
